"हठी ट्रस्टियों" के आपसी विवाद के कारण कानूनी गलियारों में छाए MGN educational trust से जुड़ी एक बड़ी खबर अपडेट हुई है। खबर यह कि स्थानीय अदालत ने "पसरीचा गुट" की याचिका पर दोनों पक्षों की सुनवाई करके "राय गुट" के 17.05.2021 के प्रस्तावित चुनाव पर रोक लगा दी है।

याची के वकील मनदीप सिंह सचदेव ने स्टे एप्लीकेशन पर हुई बहस में चुनाव अधिकार से जुड़े ऐसे-ऐसे example कोर्ट के समक्ष पेश किए कि कोर्ट ने हालातों को समझ तत्काल स्टे जारी कर दिया। अब खास बात यह भी होगी कि ट्रस्ट का चुनाव जब भी होगा तो वो 2018 की सूची के आधार पर होगा और वो भी सरकारी रिसीवर DC की देखरेख में।

कोर्ट ने दोनों गुटों के वकीलों की दलीलें सुनने के बाद माना कि "पसरीचा गुट" की चुनाव पर रोक की मांग प्रथम दृष्टया जायज है। यह भी माना कि अगर अभी चुनाव पर रोक न लगाई गई तो याची गुट के अधिकार का हनन हो जाएगा क्योंकि माननीय पंजाब एंड हरियाणा हाइकोर्ट ने जालंधर के डिप्टी कमिश्नर को चुनाव करवाने का आदेश दे रखा है।

माना जा रहा है कि कोर्ट के फैंसले से "राय गुट" के मंसूबो पर पानी फिर गया है क्योंकि 2018 के बाद ट्रस्ट को हाइजैक करके हावी हुए राय गुट ने पसरीचा गुट के एक के बाद एक मेंबरों को डिसमेंबर कर दिया था जिसमें उनके दामाद रमणीक सिंह "टेनी" को भी पस्त कर दिया था।

मगर अब इस फैंसले से उनको भी "संजीवनी" मिल गयी है और पसरीचा गुट के वारिसों "बिल्लू-पिल्लू" के चेहरे पर भी रौनक लौट आई है। बहरहाल, कानूनी जंग से चुनाव लड़ने का अधिकार मिलने के बाद देखना शेष होगा कि "पसरीचा गुट" अब किस रणनीति के साथ राय गुट को परास्त कर पाता है।

Heard on the application under order 39 Rule 1 and 2 CPCread with section 151 CPC. As per the averments of plaintiff is that plaintiffs are the dulyelected members of the Montgomery Guru Nanak Educational TrustAdarsh Nagar, Jalandhar but in fact is a society registered under theregistrar of the forms and society. The purpose of the society is to runningthe Government added and Private School. He further contended thatdefendant no. 1 wants to take possession of society illegally and theunlawfully and the Hon’ble Punjab & Haryana High Court in the year 2012 ordered the election of the office bearers of the society under thedirections of the Deputy Commissioner.

In pursuance to the said ordersplaintiff no. 1 Jarnail Singh become Secretary and plaintiff no. 3 becomeChairman of the society of the Montgomery Guru Nanak EducationalTrust Adarsh Nagar, Jalandhar and then in the year 2015 elections whichagain conducted under the supervision of Deputy CommissionerJalandhar. Jarnail Singh and Gurinder Singh plaintiff no 1 and 3 respectively become Secretary and Chairman to the society. Then in 2018 elections defendant no. 1 Charanjit Singh Rai become Chairman of the society and funds of the trust have been used illegally and unlawfully bydefendant no. 1 without any authority. He further contended that plaintiffno. 2 Ramneek Singh was served notice to remove from the life trusteeillegally and the unlawfully by the defendants and the order passed by thedefendants to dismember the proforma defendant no. 7 is also illegal andbad.

The plaintiff contended that the defendants have conducted mismanagements and the misappropriations of funds of the trust. And the election of the trust is due in May 2021 and the defendant no. 1 to 4 wantto conduct the election on the basis of the illegal act and even they are notentitled to conduct the election hence the present suit.On notice to defendants.

The defendants put their appearance and fileda written statement and raised preliminary objections regarding themaintainability, Cause of action, non joinder and misjoinder of the parties,Jurisdiction and clean hands. And denied the averments contended by theplaintiff and raised for the dismissal of the suit of the plaintiff and he hasprayed for the dismissal of the application as well as the suit.

After hearing the contentions of the both of the parties afterperusing the case file minutely and the order passed by the Hon’blePunjab & Haryana High Court in the CWP-14260 of 2020 which isreproduce as:  “In the view of the above without going into the merits of thecontroversy, petition stands disposed off with the direction to respondentno. 4 Deputy Commissioner Jalandhar to consider and decide therepresentative dated 09.03.2020 in accordance within one week fromtoday” And the speaking order dated 27.11.2020 passed by the DeputyCommissioner which is reproduce “As from the facts and circumstancesdiscussed above, and taking cognizance of a situation where half of thetrustees are showing no confidence in the incumbent officer bearers of thetrust, it will be appropriate that an impartial court appointed functionarytake charge of montgomery Guru Nanak Educational Trust, Adarsh Nagar,Jalandahr with limited mandate of presiding over election of newmanagement passing of budget of 2019-2020 and 2020-2021 as per ruledand getting financial audit conducted under his supervision to fixresponsibility of any misappropriation”. And as per contention of parties the election of trust is goingto be held on 17.05.2021 the court has taken it to be necessary to providecongenial atmosphere to both parties for conducting fair and impartialelection of trust. So in view of above stated circumstances a direction isissued to both of the parties if they has got any plans for conducting election on 17.05.2021 then the said plans are order to be shelved tillfurther order of courts. The Court is of further view that at this stage if therelief of the temporary injunctions restraining the defendant no. 1 fromconducting election of the trust of Montgomery Guru Nanak Educational Trust except under the observations of the receiver or according to therules is not passed in favor of the plaintiff then certainly irreparable lossor damage would be caused which cannot compensated in the terms ofmoney and there is also a prima facie case or balance of convenience infavor of the plaintiff on the basis of the documents produced & contentionraised by plaintiff.

Moreover if the relief of the present nature is notgranted in favour of the plaintiff the whole purpose of filing the presentsuit shall stands defeated on the other hand defendant rights can also beprotected on merits at later stage after leading evidence from the bothsides. So in view of the above said discussion the defendants arerestrained from conducting any elections of the Montgomery Guru NanakEducational Trust, Adarsh Nagar, Jalandhar which is duly registeredsociety except under the observation of Receiver or independentgovernment observers as per the rules of the Trust which were applicablein the year 2018 and also as per the life trustees in existence thereof tillthe further orders of the court. Nothing in this order shall affect the meritsof the case and the application is disposed accordingly and the case is adjourned to 20.05.2021 for the consideration.
