कोरोना महामारी के कारण स्कूल प्रबंधन और स्टूडेंट्स के अभिभावकों के मध्य पनपा विवाद गहराता जा रहा है। ताज़ा खबर है कि माननीय पंजाब एंड हरियाणा हाइकोर्ट के डबल बेंच (DB) ने सिंगल बेंच के फैंसले पर चुनौती को स्वीकार करते हुए नोटिस ऑफ मोशन जारी किया है। माननीय DB ने अगले फैंसले तक ट्रांसपोर्ट चार्जेज वसूलने पर रोक लगा दी है और एनुअल चार्जेज भी 50% लेने का आदेश दिया है। अगली सुनवाई एक अक्टूबर 2020 को होगी। गौरतलब है कि सिंगल बेंच के आदेश के बाद स्कूल वालों का दवाब स्टूडेंट्स के माता-पिता पर बढ़ता जा रहा था। ट्यूशन फीस के साथ ट्रांसपोर्ट चार्जेज और वार्षिक चार्जेज के लिए तरह-तरह से दवाब बनाया जा रहा था। स्कूलों की यूनियन CASA भी अपने तरह से धमकाने पर उतर आई थी, जिससे lockdown के शिकार माता-पिता काफी परेशान थे और अब मामला हाइकोर्ट के समक्ष दुबारा उठाया गया है।

Case has been heard through Video Conferencing on account ofCOVID-19 Pandemic.
Challenge is to the order dated 27.7.2020 passed by the learnedSingle Judge wherein directions have been given in relation to charging feeetc. from the students in COVID-19 situation. It has been primarilycontended by learned counsel for the appellants that learned Single Judgehas placed reliance on judgment in Independent School AssociationChandigarh (Regd.) and others v. State of Punjab and others, CWP-7409-2020 decided on 30.6.2020. According to learned counsel, said orderwas passed under the Punjab Regulation of Fee of Unaided EducationalInstitutions Act, 2016. Haryana School Education Act, 1995 has beencompletely ignored while delivering the said judgment. It has further beencontended that the students are being charged transport charges though theclasses are being conducted online only. Besides, annual fee of ` 34,000/-which is meant for maintenance of the building is also being charged thoughthe building is not in use for the last almost seven months.Notice of motion for 1.10.2020.Notice re: condonation of delay in filing the appeal.Meanwhile, in view of the fact that the students are not going toschool, the transport fee may not be charged. Besides, annual chargesmeant for maintenance of the school building to the extent of 50% shallremain stayed so that school authorities are able to maintain the same.
